Terms and conditions
These terms apply to all purchases and subscriptions via fotografie-presets.nl.

Article 2. Applicability
These terms and conditions apply to every offer from Michiel Heijmans Fotografie and to every agreement concluded between the business and the consumer. The consumer accepts these terms when placing an order or taking out a subscription.
Article 3. Offer and agreement
An agreement is concluded at the moment the consumer confirms the order and payment has been received or authorised by the payment provider (Mollie). After payment, the consumer receives a confirmation and a download link by email.
Article 4. Prices and payment
- All prices are in euros and include VAT, unless stated otherwise.
- Payment is made through Mollie Payments B.V. The consumer can pay using the available payment methods (iDEAL, credit card, etc.).
- We reserve the right to change prices. The price shown at the time of purchase is binding.
Article 5. Delivery of digital products
- Presets and packs are digital products and are delivered as a download link that is valid for 90 days after purchase.
- Delivery takes place almost immediately after payment is received. In the event of a delay due to technical reasons, the consumer is informed as soon as possible.
- The business is not liable for loss of the download link after the validity period has expired. A new link can be created on request.
Article 6. Right of withdrawal
The following applies to digital products (presets, packs):
- The consumer has the right to withdraw from the agreement within 14 days of purchase, without giving a reason.
- Exception: the right of withdrawal lapses as soon as the consumer has used the download link (the file has been downloaded), provided the consumer expressly consented to immediate delivery when completing the order and confirmed waiving the right of withdrawal. This is in accordance with Article 6:230p(f) of the Dutch Civil Code.
For subscriptions, a withdrawal period of 14 days applies after taking out the subscription, provided the service has not yet been used.

Article 7. Subscriptions
- Subscriptions are billed annually. We offer annual subscriptions only.
- A subscription renews automatically each year until you cancel it. You can cancel at any time via the link in your confirmation email or via your account page. After cancellation, your access remains active until the end of the paid period.
- Cancellation after the withdrawal period has ended does not give a right to a refund of the current period.
- Discount codes for a subscription apply to the first year, unless stated otherwise.
Article 8. Licence
- Personal subscription or single purchase: the consumer may use the presets for personal, non-commercial photography.
- Commercial subscription: the consumer may use the presets for commercial work, including publications for clients and social media of business accounts.
- Reselling, redistributing or publishing the preset files themselves is prohibited in all cases.
Article 9. Liability
The business is not liable for damage arising from the use or the inability to use the digital products, unless there is intent or gross negligence. Liability is in all cases limited to the amount the consumer paid for the relevant product.
Article 10. Complaints
Complaints about products or the service can be submitted via mail@fotografie-presets.nl. We respond within 5 working days.
Article 11. Governing law and disputes
Dutch law applies exclusively to all agreements. Disputes are preferably resolved by mutual agreement. If that is not possible, the competent court is that of the Gelderland district.
